PICKSY — TERMS & CONDITIONS OF SERVICE

Welcome to PICKSY ("Picksy", "we", "us", "our"). These comprehensive Terms & Conditions ("Terms") govern your access to and commercial use of the Picksy website (https://picksy-five.vercel.app/), mobile touchpoints, digital store, consumer support channels, and fulfillment infrastructure (collectively, the "Platform").

By accessing the Platform, registering a customer account, browsing collections, adding products to cart, transferring commercial consideration, placing an order, or utilizing any Picksy service, you explicitly acknowledge that you have read, understood, and agreed to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately refrain from using the Platform or placing orders.

These Terms are formulated in rigorous adherence to the statutory enactments of the Republic of India, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023. Nothing in these Terms shall operate to unlawfully diminish or prejudice any mandatory consumer protection guarantees enacted by the Parliament of India.

1. LEGAL AGREEMENT AND BINDING NATURE

1.1This document constitutes a legally binding agreement between PICKSY ("Picksy", "Company", "we", "us", or "our"), operating the digital e-commerce platform https://picksy-five.vercel.app/ and associated digital touchpoints (collectively, the "Platform"), and any natural or legal person who accesses, browses, registers an account on, or places a commercial purchase order through the Platform ("Customer", "User", "you", or "your").

1.2By accessing or utilizing any feature of the Platform, transacting business, placing an order, or transferring consideration, you irrevocably confirm that you have carefully reviewed, comprehended, and agreed to be bound by these Terms & Conditions in their entirety, alongside all incorporated ancillary policies.

1.3If you do not unreservedly agree to each and every clause stipulated herein, you must immediately terminate access to the Platform and refrain from browsing, initiating checkout, or finalizing transactions.

2. STATUTORY COMPLIANCE UNDER APPLICABLE INDIAN LAWS

2.1These Terms are formulated, executed, and governed strictly under the statutory framework of the Republic of India, specifically harmonized with:

  • The Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 as amended;
  • The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020;
  • The Indian Contract Act, 1872;
  • The Sale of Goods Act, 1930;
  • The Digital Personal Data Protection Act, 2023 (DPDPA);
  • The Legal Metrology Act, 2009 and Legal Metrology (Packaged Commodities) Rules, 2011; and
  • The Central Goods and Services Tax Act, 2017 (CGST), Integrated GST Act, 2017 (IGST), and relevant State GST statutes.

2.2Nothing in these Terms shall operate to extinguish, abridge, or unlawfully restrict any non-waivable statutory consumer rights guaranteed under mandatory enactments of the Indian Parliament.

3. ELECTRONIC RECORD AND DIGITAL SIGNATURE STATUS

3.1This document is published in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates publishing the rules, regulations, privacy policy, and terms of use for access to or usage of an e-commerce marketplace and online retail website.

3.2This electronic record is generated by an automated computer system and does not require any physical or digital signatures to maintain full legal validity and enforceability under Section 10A of the Information Technology Act, 2000.

4. ELIGIBILITY AND CONTRACTUAL CAPACITY

4.1In terms of Section 11 of the Indian Contract Act, 1872, only individuals who have attained the age of majority (18 years or older), are of sound mind, and are not disqualified from contracting by any applicable law are eligible to independently register, transact, or purchase on the Platform.

4.2Any individual below the age of 18 years ("Minor") may browse the Platform or place an order solely through, with the active supervision of, and under the explicit legal consent of their parent or lawful legal guardian.

5. PARENTAL GUARDIANSHIP AND MINOR TRANSACTIONS

5.1Where an order is placed by or on behalf of a minor, the parent or legal guardian shall be deemed to have fully ratified the commercial contract, agreed to these Terms, and assumed full financial liability for payment of all amounts due.

5.2PICKSY reserves the unconditioned right to cancel any order and terminate any account immediately upon discovering that an unregistered minor has executed unauthorized financial transactions without verifiable parental consent.

6. ACCOUNT REGISTRATION AND AUTHENTICITY

6.1While guest checkout may be permitted for select items, customers creating an account on PICKSY warrant that all submitted details, including legal name, operational mobile telephone number, valid electronic mail address, and residential postal address, are true, current, and exhaustive.

6.2You agree not to impersonate any other individual or entity, nor employ fictitious or misleading identities during registration or checkout.

7. ACCOUNT CREDENTIALS AND ACCESS SECURITY

7.1You are solely responsible for preserving the utmost confidentiality of your account credentials, secret passwords, two-factor authentication codes, and security tokens.

7.2You agree to accept full responsibility for all activities, order commitments, and payments originating from your account or authorized session tokens. PICKSY shall not be liable for any losses caused by unauthorized credential sharing.

8. ACCURACY OF CUSTOMER COMMUNICATIONS AND NOTICES

8.1All statutory notifications, tax invoices, order updates, shipment tracking links, and legal correspondence dispatched to the email or mobile phone number registered on your account shall be deemed legally received within 24 hours of transmission.

8.2It is the customer's affirmative obligation to notify PICKSY immediately of any changes to their contact details.

9. PROHIBITION OF MULTIPLE, GHOST, OR AUTOMATED ACCOUNTS

9.1The creation of multiple accounts by a single customer or coordinated group to circumvent purchasing quotas, abuse promotional coupon codes, hoard limited drop inventory, or disguise abusive return behavior is strictly prohibited.

9.2PICKSY utilizes automated algorithmic fingerprinting to detect linked ghost accounts, reserving the right to consolidate, freeze, or cancel all associated orders without indemnity.

10. TERMINATION, SUSPENSION, AND ACCOUNT CLOSURE

10.1PICKSY reserves the explicit right, without prejudice to other statutory remedies, to temporarily suspend or permanently terminate any user account, blacklist delivery addresses, or refuse service in circumstances involving:

  • Suspected payment fraud, stolen credit cards, or unauthorized UPI accounts;
  • Repeated frivolous returns, fraudulent unboxing claims, or bad-faith chargebacks;
  • Systematic refusal of Cash on Delivery (COD) shipments at the customer's doorstep (high RTO rate);
  • Abusive, threatening, or vulgar conduct directed at our customer service personnel or delivery courier agents; or
  • Material breach of any provision of these Terms or applicable laws.

11. DIGITAL CATALOG AND PRODUCT REPRESENTATION

11.1PICKSY makes diligent, commercially reasonable efforts to accurately display product titles, photographic images, graphic prints, silhouettes, fabric compositions, and dimensional attributes on the Platform.

11.2All digital previews and photographic depictions are intended to furnish a visual representation; subtle variations may occur due to technical parameters.

12. COLOR AND DISPLAY CALIBRATION VARIATIONS

12.1Because color rendering depends heavily upon individual monitor calibrations, smartphone screen panels (OLED, AMOLED, LCD), color temperature profiles, and studio lighting, the actual optical shade of a garment may exhibit slight, non-material variances from your device screen.

12.2Such natural visual nuances do not constitute a defect or misrepresentation under the Consumer Protection Act, 2019 provided the delivered article substantially corresponds to the specifications.

13. HEAVYWEIGHT FABRIC SPECIFICATIONS (220+ GSM COTTON)

13.1Unless otherwise specified on a product page, PICKSY streetwear t-shirts are fabricated utilizing 100% combed heavy-duty 220+ GSM cotton textiles engineered for durability, structured drape, and thermal breathability.

13.2Heavyweight combed cotton possesses inherent natural fiber characteristics. Minimal residual shrinkage (not exceeding 3-5%) post the first cold wash cycle is standard across textile manufacturing and is accommodated in the oversized cut.

14. PRINT DURABILITY, PUFF PRINTING & WASH CARE MANDATE

14.1Apparel incorporating screen prints, plastisol ink, puff prints, or heat-cured graphic artwork must be maintained strictly according to our published wash instructions:

  • Machine wash inside-out using cold water (30°C or below);
  • Employ gentle liquid detergents; refrain from bleaching agents or enzyme soaks;
  • Line dry in shade; strictly avoid tumble drying under high heat;
  • Never apply a heated flatiron directly onto printed or embossed art surfaces; iron on reverse only.

14.2PICKSY disclaims all product defect liability for print peeling, cracking, or textile shrinkage attributable to hot washing, mechanical tumble drying, or direct ironing.

15. SIGNATURE OVERSIZED STREETWEAR SILHOUETTE & SIZING

15.1PICKSY apparel is intentionally designed with an authentic, signature oversized streetwear fit featuring dropped shoulders, wider chest circumferences, and relaxed boxy cuts.

15.2Customers seeking a traditional, snug, or regular slim fit are explicitly advised to consult the published size chart on the respective product page and select one size smaller than their conventional vanity apparel size.

16. LEGAL METROLOGY (PACKAGED COMMODITIES) COMPLIANCE

16.1In accordance with the Legal Metrology (Packaged Commodities) Rules, 2011, all packaged goods retailed via the Platform display statutory declarations including product name, net quantity, dimensions, maximum retail price (MRP inclusive of all taxes), consumer care details, month/year of manufacture, and registered brand address.

17. COUNTRY OF ORIGIN AND SUPPLY CHAIN TRANSPARENCY

17.1All apparel garments designed, printed, stitched, and fulfilled under the PICKSY brand indicate India as their statutory Country of Origin, honoring consumer transparency regulations governed by the Ministry of Consumer Affairs.

18. LIMITED DROPS AND INVENTORY VOLATILITY

18.1Streetwear collections and promotional drops are curated in limited quantities. PICKSY does not guarantee continuous replenishment of specific designs, sizes, or colorways once production runs sell out.

19. SHOPPING CART STATUS VS. CONTRACTUAL RESERVATION

19.1Placing an item in your digital shopping cart or wish list does not reserve the inventory or lock the price. Goods remain freely accessible for purchase by other customers until an order is successfully confirmed through valid payment or token checkout.

20. QUANTITY RESTRICTIONS AND ANTI-RESELLING CLAUSE

20.1Products retailed on the Platform are intended strictly for end-user personal consumption. PICKSY prohibits commercial reselling, wholesale arbitrage, or unapproved retail redistribution.

20.2We reserve the right to limit the maximum purchase quantity per customer, per credit card, per delivery address, or per IP address across any product drop.

21. CURRENCY AND PRICING BASIS

21.1All commercial prices quoted on the Platform are stated in Indian National Rupees (INR / ₹) and are inclusive of applicable goods and services taxes, unless explicitly bifurcated at the final checkout summary.

22. GOODS AND SERVICES TAX (GST) AND STATUTORY INVOICES

22.1Every commercial dispatch is accompanied by an authorized GST Tax Invoice issued in compliance with the Central Goods and Services Tax Act, 2017. Digital copies are retrievable directly via your order confirmation or the Track Order portal.

23. CLERICAL, PRICING, AND TYPOGRAPHICAL ERRORS

23.1In the rare event that a product is mistakenly listed at an incorrect price or with erroneous specifications due to typographical, technical, or supplier database errors, PICKSY reserves the statutory right to cancel any affected order—even if the transaction was acknowledged or your payment instrument was debited.

23.2In such instances, any funds debited shall be immediately and unconditionally refunded in full to your original payment source.

24. PRICE FLUCTUATION AND UNILATERAL REVISION

24.1PICKSY reserves the prerogative to modify product prices, promotional discounts, and shipping charges at any time without prior announcement. However, verified orders that have received a formal dispatch notification shall not be subjected to retroactive price escalations.

25. SHIPPING CHARGES AND PAN-INDIA FREE DELIVERY

25.1PICKSY presently offers 100% FREE standard shipping across serviceable Indian pincodes on qualified prepaid and COD orders. Where specialized express, air-courier, or remote-region surcharges apply, they shall be transparently itemized before payment authorization.

26. PROMOTIONAL VOUCHERS AND COUPON REDEMPTION

26.1Promotional discount codes, influencer promo vouchers, and welcome credits issued by PICKSY are non-transferable, possess zero independent cash surrender value, and may be redeemed only against eligible products during their declared validity window.

27. PROHIBITION OF COUPON STACKING AND EXPLOITATION

27.1Unless explicitly sanctioned in writing, customers may apply only one promotional coupon per commercial order. Attempting to stack, automate, or exploit discount coupons through algorithmic script injections constitutes fraud and shall lead to immediate order cancellation.

28. LOYALTY CREDITS, CASHBACK, AND CAMPAIGN REWARDS

28.1Any store credit, digital wallet token, or seasonal cashback awarded by PICKSY is subject to expiration schedules and account verification. Credits cannot be withdrawn to physical bank accounts or traded for monetary fiat.

29. DISCONTINUATION OR MODIFICATION OF MARKETING OFFERS

29.1PICKSY retains the absolute discretion to suspend, alter, or terminate any ongoing discount campaign, festive sale, flash deal, or promotional code at any stage in compliance with fair trade guidelines under the Consumer Protection Act, 2019.

30. OFFER, INVITATION TO OFFER, AND ACCEPTANCE

30.1The catalog listing of products on the Platform constitutes an 'invitation to offer' (invitation to treat) under the Indian Contract Act, 1872. Your action of submitting an order constitutes a formal contractual offer to purchase.

30.2A legally binding contract of sale is perfected only when PICKSY physically dispatches the ordered goods and transmits a formal Shipment Dispatch Notification with a logistics tracking AWB number.

31. AUTOMATED ORDER ACKNOWLEDGMENT NOTICE

31.1Any automated email, SMS, or on-screen confirmation generated immediately upon checkout is solely an acknowledgment of receipt of your purchase proposal. It does not signify formal merchant acceptance where operational, pricing, or security reviews remain pending.

32. HIGH-RISK VERIFICATION AND ANTI-FRAUD SCREENING

32.1To protect consumers and payment ecosystems from cyber fraud, PICKSY subjects orders to automated risk screening. We may request secondary telephonic or OTP confirmation prior to processing high-value transactions.

33. RIGHT TO REFUSE SUSPICIOUS OR BOT-GENERATED ORDERS

33.1PICKSY reserves the unequivocal right to cancel and decline fulfillment of orders suspected to have been placed by automated scraping bots, scalpers, unauthorized API interceptors, or fraudulent credit rings.

34. INVENTORY STOCKOUT AND POST-ORDER UNAVAILABILITY

34.1If an item becomes unavailable following order submission due to inventory discrepancies, batch quality rejections, or sudden supplier failure, PICKSY will promptly notify you and process an immediate, 100% full refund to your original payment mode.

35. CUSTOMER CANCELLATION WITHIN THE 12-HOUR WINDOW

35.1A customer may freely request cancellation of an order within 12 hours from initial order placement, provided the order has not already undergone warehouse dispatch or 3PL courier handover.

35.2Cancellations within this 12-hour window may be submitted effortlessly via the My Orders portal or by communicating immediately with customer support at trypicksy@gmail.com.

36. POST-DISPATCH LOCKOUT AND CANCELLATION INELIGIBILITY

36.1Once an order has been packed, assigned an Air Waybill (AWB) number, and handed over to logistics carriers, technical cancellation is no longer possible. Customers wishing to return items post-delivery must utilize our standard 3-day return procedure.

37. COMPLIANCE WITH E-COMMERCE RULES REGARDING CANCELLATION CHARGES

37.1In strict compliance with Rule 6(5) of the Consumer Protection (E-Commerce) Rules, 2020, PICKSY shall not levy unilateral cancellation charges upon a consumer unless equivalent contractual liabilities are borne by PICKSY when terminating orders unilaterally without legitimate statutory cause.

37.2Where administrative logistics recovery charges (such as ₹25 handling charges) are lawfully applicable and mutually agreed post-cancellation window, such deductions shall be implemented strictly within legal bounds.

38. UNILATERAL MERCHANT CANCELLATIONS & REFUND MANDATE

38.1Where PICKSY unilaterally cancels a prepaid order due to serviceability failure, transit embargoes, or force majeure, the entire collected consideration shall be credited back to the customer within statutory timelines without penalty.

39. AUTHORIZED PAYMENT CHANNELS & GATEWAY INTEGRATION

39.1PICKSY facilitates 100% secure, encrypted digital payments through RBI-authorized payment aggregators (including Razorpay), supporting Unified Payments Interface (UPI - GPay, PhonePe, Paytm, BHIM), RuPay, Visa, Mastercard, Net Banking, and authorized digital wallets.

40. THIRD-PARTY PAYMENT INTERMEDIARY DISCLAIMER

40.1Online payments are processed through third-party banking gateways governed by the Payment and Settlement Systems Act, 2007. PICKSY does not operate as a financial intermediary and disclaims liability for transient server timeouts, gateway drops, or erroneous bank debits occurring within banking infrastructure.

41. PROHIBITION OF UNAUTHORIZED PAYMENT INSTRUMENTS

41.1Customers warrant that they are lawfully authorized to use the credit card, debit card, net banking account, or UPI VPA utilized during checkout. Use of cloned, stolen, or compromised payment instruments is an offense under Sections 43, 66, and 66D of the IT Act, 2000.

42. ZERO STORAGE OF COMPLETE CARD CREDENTIALS

42.1In accordance with Reserve Bank of India (RBI) tokenization guidelines, PICKSY never stores complete credit/debit card numbers, CVV security codes, or banking net-passwords on its servers. Tokenized credentials are secure within PCI-DSS certified gateway vaults.

43. TRANSACTION FAILURES AND RECONCILIATION TIMELINES

43.1If funds are debited from your bank account but the Platform fails to generate an order due to a network interruption, banking reconciliation protocols will automatically reverse the sum back to your bank account within 3 to 7 working days.

44. CHARGEBACK CLAIMS AND DISPUTE RESOLUTION

44.1Customers agree to communicate directly with PICKSY customer support to resolve any transaction dispute before initiating bank chargebacks. In the event of a fraudulent chargeback claim on an authentically delivered parcel, PICKSY will submit courier OTP, geo-tagged delivery logs, and legal documentation to the acquiring bank.

45. CASH ON DELIVERY (COD) FACILITY ARCHITECTURE

45.1PICKSY extends Cash on Delivery (COD) across select Indian pin codes to facilitate seamless transactions. Under COD, the primary product consideration is paid in physical cash or on-spot courier UPI at the moment of parcel delivery.

46. MANDATORY ₹99 ADVANCE CONFIRMATION & INVENTORY TOKEN

46.1To prevent rampant fictitious orders, automated bot spam, and reckless refusal of shipments at delivery doorsteps, all Cash on Delivery orders require an online advance confirmation token of ₹99 payable during checkout via Razorpay/UPI.

47. NATURE, APPLICATION, AND ADJUSTMENT OF THE ₹99 TOKEN

47.1The ₹99 token is NOT an extra, hidden, or non-disclosed fee. The entire ₹99 token is mathematically deducted from your final payable order total at the time of delivery. You pay only the remaining net balance to the delivery courier.

48. TOKEN REFUND RULES ON TIMELY CANCELLATION

48.1If a COD order is cancelled within the permitted 12-hour cancellation window prior to warehouse dispatch, the ₹99 advance token shall be refunded 100% in full to the customer's original UPI/bank account.

49. TOKEN FORFEITURE ON MALICIOUS DOORSTEP REFUSAL

49.1Where an order has been dispatched, undergone transport, and is subsequently rejected or deliberately refused at the doorstep by the customer without legitimate defect cause, the ₹99 token shall be forfeited to defray two-way logistics, packaging, and handling dead-freight expenses incurred.

50. BLACK-LISTING AND COD RESTRICTION FOR HIGH RTO ACCOUNTS

50.1PICKSY actively monitors Return-to-Origin (RTO) metrics. Customers or delivery locations linked to multiple unaccepted deliveries or bad-faith refusals may be permanently restricted to prepaid payment methods only.

51. INDEPENDENT LOGISTICS PARTNERS AND 3PL INTEGRATION

51.1PICKSY collaborates with reputed, licensed third-party logistics (3PL) partners and aggregators (including Shiprocket, Delhivery, Bluedart, Shadowfax, and DTDC) for express pan-India order fulfillment.

52. STANDARD DISPATCH AND ESTIMATED DELIVERY TIMELINES

52.1Confirmed orders are ordinarily inspected, packaged, and dispatched from our fulfillment facility within 24 to 48 business hours.

52.2Estimated delivery across major Indian metropolitan centers and tier-2/tier-3 pin codes is typically concluded within 10 to 14 business days, barring exceptional transit circumstances.

53. NON-GUARANTEE OF EXACT DELIVERY TIMELINES

53.1While PICKSY strives for prompt fulfillment, stated transit periods are commercial estimates rather than contractual guarantees. Time is not of the essence regarding logistics timelines unless explicitly confirmed under premium priority SLA services.

54. EXTERNAL DISRUPTIONS AND TRANSIT DELAYS

54.1PICKSY shall not be held contractually liable for transit delays caused by regional road closures, airline cargo backlogs, adverse meteorological conditions, floodings, festive rush periods, border checkpoints, regional bandhs, or national emergencies.

55. PINCODE SERVICEABILITY AND REMOTE DESTINATIONS

55.1Serviceability depends upon the courier network's operational reach across 25,000+ Indian pincodes. If an entered pincode falls within an unserviceable or Out-of-Delivery Area (ODA), PICKSY will promptly notify you and facilitate cancellation or alternative fulfillment.

56. CUSTOMER OBLIGATION REGARDING DELIVERY ADDRESSES

56.1Customers are under a strict duty to furnish an exhaustive, accurate address including house/flat number, street name, landmark, correct 6-digit postal PIN code, and an active mobile number capable of receiving incoming courier calls and SMS OTPs.

56.2PICKSY disclaims financial liability for delivery misdirection, abandonment, or return-to-origin arising from inaccurate address entries.

57. STANDARD DELIVERY ATTEMPTS BY COURIER PARTNERS

57.1Courier delivery agents make up to three (3) consecutive attempts to deliver your consignment at the designated address before initiating an automated Return to Origin (RTO).

58. CUSTOMER UNAVAILABILITY, SAFE DROP & OTP VERIFICATION

58.1Delivery shall be deemed successfully completed upon physical handover to the customer, an authorized family member, resident, building reception, or security desk, verified through courier delivery OTP or digital receiver signature.

59. REFUSAL OF SHIPMENT AND RETURN TO ORIGIN (RTO)

59.1Where an order is returned to PICKSY as undeliverable due to recurrent customer unavailability, incorrect contact details, or deliberate door-step refusal, the shipment shall be logged as RTO.

60. DEAD FREIGHT RECOVERY FOR UNJUSTIFIED RTO

60.1For unjustified RTO occurrences, re-shipment requests may necessitate upfront payment of re-shipping fees. PICKSY reserves the right to adjust incurred outbound and return dead-freight costs against eligible refunds to the extent permitted by Indian e-commerce regulations.

61. CUSTOMER DUTY TO INSPECT PARCELS UPON RECEIPT

61.1Customers are advised to conduct a visual examination of the exterior parcel bag, tamper-evident security tape, and packaging condition at the moment of physical handover from the courier personnel.

62. TAMPERED, COMPROMISED, OR RESEALED PACKAGES

62.1If the exterior courier flyer appears torn, previously sliced, resealed with non-PICKSY tape, or substantially compromised, the customer should photograph the parcel in the courier's presence and may lawfully refuse delivery, recording 'Tampered/Damaged on Delivery' on the delivery manifest.

63. MANDATORY UNBOXING VIDEO REQUIREMENT FOR CLAIMS

63.1To preserve forensic clarity against fraudulent pilferage or false missing item allegations, customers are strongly required to record a continuous, unedited, high-resolution unboxing video from the unopened, sealed courier flyer until the complete examination of the enclosed goods.

63.2This video serves as crucial prima facie evidence for insurance claims against logistics operators regarding transit damage, incorrect variants, or missing items.

64. EVIDENTIARY THRESHOLDS FOR TRANSIT DAMAGE CLAIMS

64.1Any claim asserting transit defect, torn fabric on arrival, stained apparel, or missing articles must be accompanied by the order number, digital photographs of packaging and product, the shipping label, and unboxing video footage.

65. STATUTORY NOTICE PERIOD FOR TRANSIT DISCREPANCIES

65.1All claims regarding damaged delivery, missing articles, or receipt of wrong products must be communicated to PICKSY within 48 hours of recorded courier delivery. Claims submitted beyond this window shall not be entertained due to logistics insurance expiry.

66. COURIER FORENSIC COORDINATION AND INVESTIGATION

68. PRISTINE CONDITION REQUIREMENT FOR APPAREL RETURNS

68.1To qualify for a replacement or return, clothing articles must remain:

  • Unworn, unwashed, and unlaundered;
  • Completely free of body odors, perfumes, deodorants, cologne, cosmetics, or makeup stains;
  • With all original PICKSY brand tags, size labels, and wash tags firmly attached in their original factory placement; and

69. ABSOLUTE DISQUALIFICATION OF ALTERED OR USED GARMENTS

69.1Any clothing article that has undergone tailor alterations, stitching modifications, washing, chemical dry-cleaning, outdoor wearing, or intentional distressing shall be summarily rejected for return or refund.

70. FOOTWEAR AND SNEAKER SPECIFIC RETURN POLICY

70.1Footwear items are eligible for exchange/return for size only if tried strictly indoors on clean carpeted surfaces. Shoes exhibiting outdoor sole grime, pebble scuffs, creased toe-boxes, or missing branded shoe-boxes cannot be returned.

87. MANIPULATION OF PHOTO AND VIDEO EVIDENCE

87.1Submitting forged, digitally altered, third-party sourced, or pre-recorded manipulated video footage to fraudulently secure returns or defect refunds constitutes criminal cheating and forgery under the Bharatiya Nyaya Sanhita, 2023 (formerly Indian Penal Code, 1860).

92. PROHIBITION OF DATA SCRAPING, BOTS & REVERSE ENGINEERING

92.1Users shall not employ spiders, automated scraping robots, deep-links, data-mining algorithms, or manual processes to monitor, harvest, or replicate our proprietary catalog data, pricing structures, or software code without express prior written consent.

93. AUTHENTICITY OF USER RATINGS, REVIEWS AND PHOTOS

93.1Customers submitting feedback, product reviews, styling ratings, or photographic fit images warrant that they are verified purchasers and that their reviews reflect genuine, uncoerced consumer experiences.

94. PROHIBITION OF COMMERCIAL EXTORTION VIA REVIEWS

94.1Threatening negative social media exposure, false consumer court litigation, or coordinated defamatory review bombing to extort free products, discounts, or unearned refunds constitutes unlawful extortion under Indian penal law.

95. CONTENT MODERATION AND INTERMEDIARY SAFE HARBOR

95.1PICKSY reserves the absolute discretion to moderate, edit, or purge customer reviews containing profanity, competitor advertising, personal phone numbers, or unsubstantiated defamatory falsehoods, preserving platform integrity.

96. OWNERSHIP OF THE 'PICKSY' TRADEMARKS AND BRANDING

96.1The brand name 'PICKSY', logo insignia, brand mottos ('FIND. PICK. FLEX.'), domain names, website graphics, and trade dress are the exclusive intellectual property of PICKSY and protected under the Trade Marks Act, 1999.

97. COPYRIGHT ON APPAREL GRAPHICS AND ARTWORK

97.1All original typography, anime-inspired illustrations, streetwear graphics, puff-print artworks, photographic lookbooks, and website source code are proprietary works protected under the Copyright Act, 1957. Unauthorized copying or manufacturing of counterfeit duplicates will be prosecuted.

98. COUNTERFEITING AND UNAUTHORIZED MERCHANDISING

98.1Any commercial manufacturing, importing, selling, or circulating of counterfeit goods bearing unauthorized replicas of PICKSY artwork or trademarks shall trigger immediate police raids, seizure of stock, and civil damages lawsuits.

99. UNSOLICITED USER IDEAS AND VOLUNTARY SUBMISSIONS

99.1If you submit unsolicited design concepts, apparel ideas, marketing proposals, or product suggestions, you grant PICKSY a perpetual, royalty-free, irrevocable, worldwide license to utilize, refine, and commercially implement such ideas without obligation of compensation.

100. NOTICE AND TAKEDOWN MECHANISM FOR THIRD-PARTY IP

100.1PICKSY respects the intellectual property rights of all creators. If you believe any content on the Platform infringes your lawful copyright or trademark, please transmit a formal Notice of Infringement with evidentiary documentation to trypicksy@gmail.com for prompt investigation.

101. COMPLIANCE WITH DIGITAL PERSONAL DATA PROTECTION ACT, 2023

101.1PICKSY processes personal data strictly as a 'Data Fiduciary' in accordance with the provisions of the Digital Personal Data Protection Act, 2023 (DPDPA). We collect, store, and handle data solely for lawful purposes associated with fulfilling your commercial transactions.

102. PURPOSE LIMITATION IN CUSTOMER DATA COLLECTION

102.1We collect only requisite personal identifiers—such as your name, delivery address, phone number, email address, IP address, and transaction history—strictly to process orders, generate tax invoices, coordinate courier delivery, and render warranty support.

108. EXCLUSION OF CONSEQUENTIAL AND INDIRECT DAMAGES

108.1In no event shall PICKSY, its directors, officers, employees, affiliates, or logistics partners be liable for any indirect, incidental, punitive, special, or consequential damages—including loss of anticipated profits, commercial goodwill, or emotional distress—arising out of your use of or inability to use the Platform.

109. MAXIMUM AGGREGATE MONETARY LIABILITY CAP

109.1Notwithstanding any provision to the contrary, the aggregate, cumulative financial liability of PICKSY to any customer for all claims arising out of an order or transaction shall under all circumstances be strictly capped at and limited to the actual net monetary consideration received by PICKSY for the specific product giving rise to the dispute.

110. COMPREHENSIVE CUSTOMER INDEMNIFICATION

110.1You agree to defend, indemnify, and hold harmless PICKSY, its founding partners, officers, employees, agents, and licensors from and against any claims, losses, liabilities, judgments, damages, fines, penalties, and legal expenses (including reasonable attorney fees) arising from:

  • Your breach or violation of any provision of these Terms or applicable laws;
  • Your provision of false, fraudulent, or defamatory content or unboxing claims;
  • Your infringement of any third-party intellectual property or privacy rights; or
  • Your unlawful or unauthorized utilization of payment instruments or banking accounts.

111. FORCE MAJEURE AND EXTRAORDINARY EVENTS

111.1PICKSY shall not be held responsible for non-performance, logistical delays, or fulfillment failure resulting from acts of God, extreme natural catastrophes, pandemics, epidemics, government lockdowns, regional riots, wars, transport embargos, electrical grid collapse, or cyber telecommunication blackouts beyond our reasonable control.

118. MANDATORY AMICABLE CONCILIATION PERIOD

118.1Prior to initiating formal arbitral or judicial proceedings, the parties agree to attempt in good faith to resolve any dispute, controversy, or claim arising out of these Terms through mutual conciliation for a mandatory period of 30 calendar days from written notice.

119. BINDING ARBITRATION (ARBITRATION & CONCILIATION ACT, 1996)

119.1Any dispute not amicably resolved within 30 days shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator mutually appointed by PICKSY and the claimant.

119.2The legal seat and venue of arbitration shall be Kolkata, West Bengal, India. The language of arbitration shall be English, and the arbitral award shall be final, conclusive, and binding on both parties.

120. EXCLUSIVE TERRITORIAL JURISDICTION (KOLKATA, WEST BENGAL)

120.1Subject to the arbitration agreement above, and to the fullest extent permitted under applicable law, all legal suits, court actions, or judicial proceedings shall be subject to the exclusive territorial jurisdiction of the competent civil courts located in Kolkata, West Bengal, India.

121. CLASS ACTION AND MASS LITIGATION WAIVER

121.1You agree that all disputes must be resolved on an individual basis. To the maximum extent permitted by applicable law, you waive any right to initiate, join, or participate as a plaintiff or class member in any class, collective, coordinated, or representative proceeding against PICKSY.

122. SEVERABILITY OF PROVISIONS

122.1If any court or competent judicial authority holds any provision of these Terms to be invalid, void, unlawful, or unenforceable, such determination shall not impair the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

123. NO IMPLIED WAIVER

123.1No failure, delay, or forbearance on the part of PICKSY in exercising any right, power, or statutory privilege under these Terms shall operate as an implied waiver thereof, nor shall any single exercise preclude any further exercise of rights.

124. ENTIRE AGREEMENT AND INTEGRATION CLAUSE

124.1These Terms, together with our Privacy Policy, Return & Replacement Policy, Shipping Guide, and invoice declarations, constitute the entire, definitive, and complete agreement between you and PICKSY, superseding all prior oral, written, or electronic representations.

125. SURVIVAL POST-TERMINATION

125.1Provisions that by their inherent nature ought to survive termination—including Intellectual Property, Indemnification, Limitation of Liability, Dispute Resolution, Governing Law, and Data Protection mandates—shall survive any account termination or order closure.
